Please read these Terms and Conditions carefully before placing an order with Peacocks & Petals. By placing an order online, you agree to be bound by these Terms and Conditions in full. If you do not agree with any part of these Terms, please do not proceed with your order.

2 Products & Services

Peacocks & Petals offers the following floristry products and services:

  • Fresh cut flowers
  • Bouquets and floral arrangements
  • Event floristry
  • Funeral flowers
  • Dried and artificial flowers

All fresh flowers and arrangements are subject to seasonal availability. Specific varieties, colours, and stems may not always be available. Where a substitution is necessary, we will use flowers of equivalent quality, value, and aesthetic to fulfil your order. We will not substitute in a way that significantly alters the overall look or style without contacting you first.

3 Placing an Order

All orders are placed online via our website at www.peacocksandpetals.uk. You are solely responsible for ensuring that all information you provide at the time of ordering is accurate and complete. This includes, but is not limited to:

  • Full and correct delivery address (including postcode)
  • Recipient name and contact details
  • Preferred delivery date
  • Any special instructions or personalisation requests
Important

Anomalies or errors submitted during the ordering process — including incomplete addresses, incorrect contact details, unclear special instructions, or conflicting information — may result in delays, failed deliveries, or other problems with your order. Peacocks & Petals cannot accept liability for any issues arising directly from inaccurate or incomplete information provided by you at the time of ordering.

An order is not confirmed until you receive a confirmation notification from us. We reserve the right to decline any order at our sole discretion. If we are unable to fulfil your order, any payment taken will be refunded in full within 14 days.

4 Pricing & Payment

All prices displayed on our website are in pounds sterling (GBP). Prices are inclusive of any applicable VAT.

Full payment is required at the time of placing your order, with the exception of wedding and large event bookings, for which a deposit arrangement applies (see Section 5 below). Your order will not be confirmed or progressed until payment has been successfully processed.

We reserve the right to amend our prices at any time without prior notice. Price changes will not affect any order that has already been confirmed and paid for.

5 Wedding & Large Event Bookings

For wedding floristry and large event orders, a deposit is required to secure your date and begin consultation. The deposit amount and the balance payment schedule will be confirmed to you in writing at the time of booking.

Please note the following specific conditions for wedding and event bookings:

  • The deposit is non-refundable once paid, as it covers our time in consultation, planning, and reservation of your date.
  • The remaining balance must be paid in full by the date agreed and confirmed in writing at the time of booking.
  • Failure to pay the balance by the agreed date may result in cancellation of your booking, with the deposit forfeited.
  • Any amendments to a confirmed wedding or event order must be requested in writing and are subject to our agreement and any applicable price adjustment.

6 Delivery & Collection

6.1 Delivery Area

Peacocks & Petals is a Leicester-based business. We deliver exclusively within Leicester and selected areas of Leicestershire. It is your responsibility to confirm, before placing your order, that your delivery address falls within our delivery coverage area. If you are unsure whether your address qualifies, please contact us at peacockspetals@gmail.com before ordering.

We are unable to accept liability for orders placed with a delivery address outside our coverage area. If this occurs, we will contact you to discuss alternatives, which may include arranging collection or cancellation with a full refund.

6.2 Collection

If delivery is not available to your area, or if you prefer to collect your order, collection can be arranged at a mutually convenient location agreed between you and Peacocks & Petals at the time of ordering. The collection location and time will be confirmed to you in writing.

Please ensure you are available at the agreed collection time and location. We are not responsible for orders that cannot be fulfilled due to the customer's non-attendance at the agreed collection point.

6.3 Delivery Dates & Times

We will make every reasonable effort to deliver on the date you have requested. However, delivery dates and time windows are estimates only and are not guaranteed. Factors outside our reasonable control — including adverse weather, road conditions, or the recipient's unavailability — may cause delays.

Where a delivery cannot be completed because no one is available to receive the flowers, we will attempt to contact you using the details provided. Perishable items left unattended at a delivery address are entirely at the customer's risk. A re-delivery attempt may incur an additional charge.

7 Cancellations & Your Right to Cancel

7.1 Our Cancellation Policy

All sales are final once your order has been confirmed and payment has been processed. As a general rule, we do not accept cancellations or issue refunds for confirmed orders, as preparation for your arrangement typically begins promptly after confirmation.

If you believe you have exceptional circumstances, please contact us as soon as possible at peacockspetals@gmail.com and we will consider your request on an individual basis. We are under no obligation to accept a cancellation or issue a refund outside the circumstances described in these Terms.

7.2 Your Statutory Right to Cancel (Online Orders)

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, consumers placing orders online ordinarily have a 14-day right to cancel. However, this right does not apply to goods that are liable to deteriorate or expire rapidly, as provided under Regulation 28(1)(b) of those Regulations.

Fresh flowers and perishable floral arrangements fall within this exemption. Accordingly, by placing an order with us for fresh flowers or perishable arrangements, you acknowledge and agree that your statutory 14-day right to cancel does not apply to that order.

This exemption does not apply to dried or artificial flowers, which are non-perishable. For orders consisting solely of dried or artificial products, your statutory 14-day right to cancel applies. To exercise this right, please contact us in writing at peacockspetals@gmail.com within 14 days of receiving your order. Returned items must be unused and in their original condition.

7.3 Cancellation by Us

In exceptional circumstances beyond our reasonable control — including but not limited to severe weather, supply chain failure, illness, or other force majeure events — we reserve the right to cancel your order. We will notify you as soon as reasonably practicable and will issue a full refund within 14 days.

8 Product Quality & Complaints

We are committed to providing flowers and arrangements of high quality. All fresh flowers are perishable and have a natural lifespan that varies by variety and environmental conditions. Care instructions will be included with your order; following them will help to maximise the longevity of your flowers.

If you have a complaint about the quality of your order — for example, if flowers arrive damaged, wilted, or significantly not as described — you must contact us within 24 hours of delivery at peacockspetals@gmail.com. Please include:

  • Your order reference number
  • A clear description of the issue
  • Photographs of the flowers or arrangement as received

Complaints raised after 24 hours of delivery, or without supporting photographic evidence, may not be considered. We will assess each complaint on a case-by-case basis and, at our discretion, may offer one of the following remedies: a replacement arrangement, a partial or full refund, or a credit note. We will always endeavour to reach a fair outcome.

We are not liable for deterioration in the condition of fresh flowers caused by improper care after delivery or collection, exposure to extreme temperatures, or other factors outside our control once the order has left our hands.

9 Refunds

Where a refund is agreed — whether under our complaints process, due to cancellation by us, or under your statutory rights where applicable — it will be processed within 14 days of our agreement to refund. Refunds will be made to the original payment method used at the time of ordering wherever possible.

Nothing in these Terms limits or removes your rights under the Consumer Rights Act 2015, including your right to goods of satisfactory quality, fit for purpose, and as described.

10 Limitation of Liability

To the fullest extent permitted by applicable law, the total liability of Peacocks & Petals to you in connection with any order shall not exceed the total price paid by you for that order.

We shall not be liable for any indirect, incidental, or consequential loss arising from or in connection with your order, including but not limited to: loss of enjoyment, distress arising from delivery delays, or reputational harm, except where such losses arise from our negligence or breach of contract.

Nothing in these Terms excludes or limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any other liability that cannot lawfully be excluded or limited under English law.

11 Events Outside Our Control

We will not be in breach of these Terms, nor liable for any delay or failure to perform our obligations, where such delay or failure arises from events or circumstances beyond our reasonable control. Such events include but are not limited to: severe weather conditions, natural disasters, pandemic or epidemic, supply chain disruption, power failure, strikes, or civil disturbance. We will inform you of such circumstances as soon as reasonably practicable and take all reasonable steps to minimise disruption to your order.

12 Intellectual Property

All content on our website — including but not limited to text, photographs, logos, branding, and design — is the intellectual property of Peacocks & Petals or its licensors and is protected by copyright and other applicable intellectual property laws. You may not copy, reproduce, distribute, or otherwise use any content from our website without our prior written consent.

13 Privacy & Data Protection

We process your personal data in accordance with our Privacy Policy, which is available on our website at www.peacocksandpetals.uk. We collect and use your personal information solely for the purposes of processing and fulfilling your order, managing our customer relationship, and — where you have opted in — sending you marketing communications.

As a sole trader operating in the UK, we comply with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. You have the right to access, correct, or request deletion of your personal data at any time by contacting us at peacockspetals@gmail.com.

Any dispute arising out of or in connection with these Terms — including any question regarding their existence, validity, or termination — shall be subject to the exclusive jurisdiction of the courts of England and Wales.

As a consumer, you retain any rights you may have under the laws of your country of residence. If you are based in the United Kingdom, your statutory consumer rights are not affected by these Terms.

16 Changes to These Terms

We reserve the right to amend these Terms and Conditions at any time. The most current version will always be published on our website at www.peacocksandpetals.uk, along with the date on which the Terms were last updated. Your continued use of our website or placing of an order following any amendment constitutes your acceptance of the revised Terms.
